About the Platform
Welcome to the PHOENIX Platform (Health Optimization through Education, Networking, Innovation, and eXpertise), a digital learning and workforce development system operated by LumiereCore ("we", "us", or "our"). PHOENIX is a full-stack Learning Management System designed to serve Kenya's health workforce, including Health Officers (PHOs), Health Technicians (PHTs), instructors, institutions, county administrators, and Ministry of Health stakeholders across East Africa.
Acceptance of Terms
By registering for an account, accessing, or using any part of the PHOENIX Platform, you confirm that:
- You are at least 18 years of age or have the consent of a legal guardian.
- You have read, understood, and agree to be bound by these Terms and Conditions.
- You agree to comply with all applicable laws and regulations in your jurisdiction.
- If you are registering on behalf of an institution, you have the authority to bind that institution to these terms.
User Accounts and Registration
PHOENIX supports multiple account types including Learners, Instructors, Institutions, County Administrators, Administrators, and Super Administrators. Each account type has defined permissions and access levels as determined by LumiereCore.
You are responsible for providing accurate, current, and complete information during registration. LumiereCore reserves the right to suspend or terminate accounts with inaccurate or misleading information.
You are solely responsible for maintaining the confidentiality of your login credentials. You must notify LumiereCore immediately at info@lumierecore.org if you suspect unauthorized access to your account. LumiereCore will not be liable for any loss or damage arising from unauthorized access due to your failure to safeguard your credentials.
Instructor accounts are not self-registered. Prospective instructors must submit a formal request through the platform. Approval is at the sole discretion of LumiereCore administrators. Approved instructors will receive login credentials via email.
Institutions register directly on the platform. Institutions are responsible for managing their internal users, including inviting learners, HR Admins, Supervisors, and Department Admins through the Institution Invite Center. Institutions may not share account credentials across multiple entities.
Permitted Use
You agree to use the PHOENIX Platform solely for lawful educational, professional development, and workforce management purposes. Permitted uses include:
- Enrolling in and completing courses aligned with the One Health Workforce (OHW) Competency Framework.
- Creating and publishing courses (Instructors only, subject to approval).
- Managing institutional learners, tracking progress, and generating workforce intelligence reports (Institutions only).
- Participating in webinars, live classes, and community discussions.
- Booking 1-on-1 sessions with approved instructors through the calendar system.
Prohibited Use
You agree NOT to:
- Use the platform for any unlawful, fraudulent, or unauthorized purpose.
- Upload, share, or distribute content that is defamatory, offensive, discriminatory, or infringes on the intellectual property rights of others.
- Attempt to gain unauthorized access to any part of the platform, other user accounts, or LumiereCore's systems.
- Use automated tools, bots, scrapers, or scripts to access or extract content from the platform without prior written consent.
- Reproduce, distribute, or resell platform content, courses, or materials without explicit written permission from LumiereCore.
- Impersonate any person or entity, or falsely represent your affiliation with any organization.
- Introduce malware, viruses, or any other harmful code into the platform.
Intellectual Property
All content on the PHOENIX Platform, including course materials, frameworks, competency models, assessments, design systems, branding, logos, and software, is the exclusive intellectual property of LumiereCore or its licensed content providers. You may not copy, reproduce, distribute, or create derivative works without prior written consent.
By uploading or publishing content on the PHOENIX Platform, you grant LumiereCore a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that content solely for the purpose of operating and improving the platform. You retain ownership of your content.
The One Health Workforce Competency Framework integrated into this platform is developed in alignment with the OHW Competency Framework and Evaluation Toolkit (August 2022), funded under the USAID One Health Workforce — Next Generation project. LumiereCore has adapted this framework for use within the PHOENIX Platform under applicable open-use provisions.
Payments and Subscriptions
Institutions accessing the PHOENIX Platform may subscribe to one of four tiers: IT-1 Essentials, IT-2 Professional, IT-3 Enterprise, or IT-4 System Partner. Subscription fees are as agreed at the time of contracting and are subject to change with 30 days notice.
Certain courses and webinars on the platform may require payment. All prices are displayed in the applicable currency at the time of purchase. Payments are processed securely via Paystack, which supports M-Pesa, Visa, Mastercard, American Express, Apple Pay, and Pesalink.
Refunds for course purchases may be requested within 7 days of purchase, provided the learner has not completed more than 20% of the course content. Institutional subscription refunds are governed by the terms of the individual subscription contract. All refund requests must be submitted to info@lumierecore.org.
LumiereCore reserves the right to suspend access to paid features in the event of a failed or reversed payment. Institutions will be notified before any suspension of service.
Certifications and CPD Points
PHOENIX issues digital certificates and Continuing Professional Development (CPD) points upon successful completion of courses. Certificates are subject to the following conditions:
- Learners must meet the minimum passing score for the applicable proficiency level (L1: 60%, L2: 70%, L3: 80%, L4: 90%).
- CPD points are awarded as specified per course and are non-transferable between users.
- LumiereCore reserves the right to revoke certificates in cases of academic dishonesty or violation of these Terms.
- PHOENIX certificates are issued under the authority of LumiereCore and do not carry regulatory certification unless explicitly stated.
Institutional Readiness Score (IRS)
The Institutional Readiness Score (IRS) is a proprietary composite metric developed by LumiereCore to assess workforce competency health. The IRS is:
- Available to IT-2 Professional tier and above institutions.
- Calculated based on learner activity, assessment data, supervisor observations, and K4 checklist submissions.
- Provided for informational and workforce planning purposes only. It does not constitute a regulatory assessment or official government certification.
- Subject to change as LumiereCore refines its calculation methodology.
Privacy
Your use of the PHOENIX Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the platform, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.
Termination
LumiereCore reserves the right to suspend or terminate your account at any time, with or without notice, for:
- Violation of these Terms and Conditions.
- Non-payment of applicable fees.
- Conduct that LumiereCore determines, in its sole discretion, to be harmful to other users, the platform, or LumiereCore's reputation.
Disclaimer of Warranties
THE PHOENIX PLATFORM IS PROVIDED AS IS AND AS AVAILABLE WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. LUMIERECORE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUMIERECORE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PHOENIX PLATFORM.
Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
Changes to These Terms
LumiereCore reserves the right to modify these Terms and Conditions at any time. We will notify registered users of material changes via email or a prominent notice on the platform. Your continued use of the platform following such notice constitutes your acceptance of the updated Terms.
